Performance Chip Tuning is powered by Shopify, which enables us to provide the Services to you.

Unless expressly stated otherwise in writing, Performance Chip Tuning is a retailer and seller of automotive products and is not an automotive repair facility, mechanic, installer, or vehicle service provider.

Purchase of a product from Performance Chip Tuning does not include installation, removal, repair, diagnosis, programming, calibration, adjustment, modification, or any other labor or service unless expressly agreed to in writing by Performance Chip Tuning.

SECTION 3 - PRODUCT FITMENT AND COMPATIBILITY

FITMENT IS THE CUSTOMER'S RESPONSIBILITY.

Automotive parts may vary based on vehicle year, make, model, engine, transmission, trim level, production date, options, equipment, market, region, VIN, previous repairs, aftermarket modifications, and other vehicle-specific factors.

Any fitment information, application information, vehicle information, product description, photograph, diagram, measurement, specification, recommendation, installation information, or technical information provided on our website, by email, telephone, chat, or by any employee or representative is provided for informational and reference purposes only.

Such information does not constitute an absolute guarantee that a particular product will fit or function on a particular vehicle.

THE CUSTOMER IS RESPONSIBLE FOR VERIFYING THAT THE PRODUCT IS CORRECT FOR THE CUSTOMER'S SPECIFIC VEHICLE BEFORE PURCHASE AND BEFORE INSTALLATION.

Where appropriate, customers should verify compatibility using the vehicle's VIN and/or consult the vehicle manufacturer, product manufacturer, qualified automotive technician, or other qualified professional before purchasing or installing a product.

Customers should not rely solely upon a website fitment selector, year/make/model search, product description, photograph, or recommendation as the sole means of determining compatibility.

A product may require additional hardware, components, adapters, modifications, adjustments, programming, calibration, or professional installation even when a product is described as compatible, direct-fit, bolt-on, or similar terminology.

SECTION 4 - INSTALLATION AND PROFESSIONAL INSTALLATION

WE DO NOT PROVIDE INSTALLATION SERVICES UNLESS EXPRESSLY AGREED TO IN WRITING.

We strongly recommend that automotive products be installed by a qualified professional who is familiar with the specific product and vehicle.

The customer is solely responsible for ensuring that products are installed correctly and in accordance with applicable manufacturer instructions, specifications, safety requirements, and applicable laws.

Performance Chip Tuning is not responsible for:

  • Improper installation;
  • Incorrect installation;
  • Installation by an unqualified person;
  • Failure to follow installation instructions;
  • Failure to use required hardware or components;
  • Incorrect tools or installation procedures;
  • Over-tightening, under-tightening, or incorrect adjustment;
  • Modification of a product;
  • Modification of a vehicle;
  • Installation on a damaged vehicle;
  • Installation on a modified or non-standard vehicle;
  • Installation on an incompatible vehicle;
  • Failure to verify fitment before installation; or
  • Use of a product for an application for which it was not intended.

SECTION 5 - NO LIABILITY FOR INSTALLATION LABOR OR RELATED EXPENSES

THE PURCHASE PRICE OF OUR PRODUCTS DOES NOT INCLUDE INSTALLATION, REMOVAL, REINSTALLATION, DIAGNOSTIC, INSPECTION, TROUBLESHOOTING, PROGRAMMING, CALIBRATION, OR OTHER LABOR COSTS.

To the fullest extent permitted by applicable law, Performance Chip Tuning shall not be responsible for, reimburse, or otherwise be liable for any labor, service charge, or expense incurred by the customer or any third party in connection with a product.

This includes, without limitation:

  • Installation labor;
  • Removal labor;
  • Reinstallation labor;
  • Replacement labor;
  • Mechanic charges;
  • Automotive repair-shop charges;
  • Dealer charges;
  • Diagnostic fees;
  • Troubleshooting fees;
  • Inspection fees;
  • Programming fees;
  • Calibration fees;
  • Setup fees;
  • Disassembly charges;
  • Vehicle restoration charges;
  • Towing charges;
  • Roadside assistance;
  • Vehicle transportation expenses;
  • Vehicle rental expenses;
  • Storage charges;
  • Emergency repair expenses;
  • Lost wages;
  • Lost business income;
  • Business interruption;
  • Loss of use of a vehicle;
  • Costs associated with removing an allegedly defective or incompatible product;
  • Costs associated with installing a replacement product; and
  • Any other labor, service, or related expense.

IF A PRODUCT IS FOUND NOT TO FIT, IS DETERMINED TO REQUIRE ADDITIONAL COMPONENTS, REQUIRES MODIFICATION, OR CANNOT BE INSTALLED AS EXPECTED, THE CUSTOMER'S REMEDIES ARE LIMITED TO THE REMEDIES AVAILABLE UNDER OUR APPLICABLE RETURN OR WARRANTY POLICY AND APPLICABLE LAW FOR THE PRODUCT ITSELF.

WE ARE NOT RESPONSIBLE FOR LABOR OR OTHER EXPENSES INCURRED BEFORE A FITMENT, COMPATIBILITY, DEFECT, OR INSTALLATION ISSUE IS DISCOVERED.

SECTION 6 - INSPECTION BEFORE INSTALLATION

Customers should inspect all products immediately upon receipt and before installation.

Customers should verify:

  • The product received is the product ordered;
  • The product appears undamaged;
  • The product appears to be appropriate for the intended vehicle;
  • All necessary components and hardware are present; and
  • The product is suitable for the intended application.

DO NOT INSTALL A PRODUCT IF YOU BELIEVE IT MAY BE INCORRECT, DAMAGED, DEFECTIVE, INCOMPATIBLE, OR UNSUITABLE FOR YOUR VEHICLE.

Contact us before installation if there is any question regarding the product.

Installation of a product after receiving it constitutes the customer's decision to proceed with installation, subject to any rights that cannot lawfully be waived.

SECTION 7 - VEHICLE DAMAGE AND CONSEQUENTIAL LOSS

To the fullest extent permitted by applicable law, Performance Chip Tuning shall not be responsible for damage to a vehicle or any vehicle component resulting from or allegedly resulting from installation, removal, modification, adjustment, misuse, improper installation, incorrect installation procedures, failure to follow instructions, failure to verify compatibility, or use of a product in an incompatible, damaged, modified, or non-standard vehicle.

This includes, without limitation, alleged damage to:

  • Engines;
  • Transmissions;
  • Turbochargers;
  • Superchargers;
  • Fuel systems;
  • Cooling systems;
  • Electrical systems;
  • Electronic control modules;
  • Sensors;
  • Wiring;
  • Computers;
  • Emissions systems;
  • Exhaust systems;
  • Suspension systems;
  • Braking systems;
  • Body components;
  • Interior components; and
  • Other vehicle components.

This provision does not exclude liability to the extent such exclusion is prohibited by applicable law.

SECTION 8 - ORDERS

When you place an order, you are making an offer to purchase. Performance Chip Tuning reserves the right to accept or decline your order for any reason permitted by law.

Your order is not accepted until Performance Chip Tuning confirms acceptance. We must receive and process your payment before your order is accepted.

Please review your order carefully before submitting it, including the selected product, vehicle information, quantity, shipping address, and other information.

Your purchases are subject to our applicable Return and Refund Policy and Warranty Policy.

Unless otherwise expressly stated, posted prices do not include applicable taxes, shipping, handling, customs, import charges, installation, labor, or other services.

SECTION 10 - SHIPPING AND DELIVERY

Delivery dates and shipping times are estimates only and are not guaranteed.

We are not responsible for delays caused by shipping carriers, customs processing, weather, natural disasters, labor disruptions, governmental actions, incorrect addresses, or events outside our reasonable control.

Once products are transferred to the carrier, shipping-related risks are subject to applicable law and the terms of the applicable carrier and shipping service.

Our Services, including trademarks, brands, text, displays, images, graphics, product reviews, videos, audio, designs, selection, and arrangement, are owned by Performance Chip Tuning, its affiliates, or licensors and are protected by applicable intellectual property laws.

Performance Chip Tuning is powered by Shopify, which enables us to provide the Services to you. However, purchases made through our Store are transactions directly between you and Performance Chip Tuning.

Shopify is not responsible for any aspect of sales between you and Performance Chip Tuning, including any injury, damage, loss, or claim resulting from products purchased through our Store, to the extent permitted by applicable law.

You acknowledge and agree that Shopify and its affiliates are released from claims arising from or related to your purchases and transactions with Performance Chip Tuning to the fullest extent permitted by applicable law.

We do not warrant that a product will:

  • Fit a particular vehicle;
  • Be installable without modification;
  • Operate without additional components;
  • Perform in a particular manner;
  • Produce a particular horsepower or torque increase;
  • Produce a particular fuel-economy result;
  • Produce a particular sound or performance result;
  • Operate without programming or calibration; or
  • Produce any particular result.

Product specifications, performance information, installation times, fitment information, technical information, photographs, reviews, testimonials, and other information are provided for informational purposes and may vary depending on the vehicle, vehicle condition, installation, modifications, environment, and other factors.

Nothing in these Terms is intended to exclude or limit any warranty, consumer right, or remedy that cannot legally be excluded or limited.

SECTION 21 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PERFORMANCE CHIP TUNING, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO THE PURCHASE, INSTALLATION, REMOVAL, USE, INABILITY TO USE, OR PERFORMANCE OF ANY PRODUCT OR SERVICE.

This limitation includes, without limitation:

  • Installation labor;
  • Removal labor;
  • Reinstallation labor;
  • Replacement labor;
  • Mechanic fees;
  • Automotive shop fees;
  • Dealer fees;
  • Diagnostic fees;
  • Troubleshooting fees;
  • Inspection fees;
  • Programming fees;
  • Calibration fees;
  • Towing expenses;
  • Roadside assistance;
  • Vehicle rental costs;
  • Transportation costs;
  • Storage fees;
  • Loss of use of a vehicle;
  • Lost wages;
  • Lost profits;
  • Lost revenue;
  • Business interruption;
  • Loss of business opportunity;
  • Damage to other vehicle components;
  • Costs caused by fitment or compatibility problems;
  • Costs associated with removal or replacement of products;
  • Vehicle downtime;
  • Diminution in vehicle value; and
  • Any other indirect, incidental, special, exemplary, punitive, or consequential loss or expense.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF PERFORMANCE CHIP TUNING ARISING OUT OF OR RELATING TO ANY PRODUCT, ORDER, TRANSACTION, OR CLAIM SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY THE CUSTOMER TO PERFORMANCE CHIP TUNING FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

These limitations apply regardless of the legal theory asserted, including contract, warranty, negligence, strict liability, tort, statute, or any other theory of liability, even if Performance Chip Tuning has been advised of the possibility of such damages.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.

SECTION 22 - CUSTOMER ASSUMPTION OF INSTALLATION RESPONSIBILITY

When a customer or a third party selected by the customer installs, removes, modifies, adjusts, programs, calibrates, or otherwise works on a product, the customer acknowledges that such work is performed independently of Performance Chip Tuning unless Performance Chip Tuning expressly agreed in writing to perform such work.

The customer is responsible for selecting an appropriately qualified installer and for ensuring that the installer follows applicable manufacturer instructions and safety procedures.

Performance Chip Tuning does not supervise or control the work performed by independent mechanics, installers, repair facilities, dealerships, or other third parties selected by the customer.

To the fullest extent permitted by applicable law, Performance Chip Tuning is not responsible for the acts or omissions of an independent installer or third-party service provider selected by the customer.

SECTION 23 - INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Performance Chip Tuning, its owners, officers, directors, employees, affiliates, agents, contractors, service providers, suppliers, and licensors from claims, damages, losses, liabilities, costs, and reasonable attorneys' fees arising out of or relating to:

  1. Your breach of these Terms;
  2. Your violation of applicable law or the rights of a third party;
  3. Your improper, negligent, or unauthorized installation, removal, modification, or use of a product;
  4. Your failure to verify product fitment or compatibility;
  5. Your failure to follow installation instructions or applicable safety requirements;
  6. Your use of a product on a modified, damaged, or incompatible vehicle;
  7. Work performed by a mechanic, installer, automotive shop, dealership, or other third party selected by you; or
  8. Your misuse of the Services or products.

We will provide notice of an indemnifiable claim where required by applicable law. We may participate in or control the defense of an indemnified claim as permitted by law.

This indemnification provision does not require you to indemnify Performance Chip Tuning for claims to the extent caused by Performance Chip Tuning's own conduct where such indemnification is prohibited by applicable law.

SECTION 24 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by applicable law, and the remaining provisions shall remain in full force and effect.

SECTION 25 - WAIVER; ENTIRE AGREEMENT

The failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

These Terms of Service, together with all policies and operating rules posted by us on the Services or applicable to your purchase, constitute the entire agreement between you and Performance Chip Tuning concerning your use of the Services and supersede prior or contemporaneous agreements, communications, and proposals concerning the same subject matter.

Any ambiguities in the interpretation of these Terms shall not automatically be construed against the drafting party.

You may not assign, transfer, delegate, or otherwise transfer your rights or obligations under these Terms without our prior written consent, except where prohibited by applicable law.
